1. Terms and Conditions
1.1 The signed registration form is regarded as a valid course registration. The participant will receive at the end of the registration process a carbon copy of the registration form which acts simultaneously as the course confirmation. The registration becomes then binding on both parties.

1.2 With the his/her signature on the registration form, the course participant, or in the case of minors the legal representative, is bound by contract to pay the school fees for the course registered, as outlined and in regard to amount and maturity mentioned in the registration form.

1.3 BHMS reserves the right to send the participant reminders for outstanding school fees and charge CHF 20 for the 2nd reminder and CHF 30 for the 3rd reminder, as well as to charge default interest of 1% per month on outstanding fees.

2. Organization
2.1 BHMS guarantees the participant a thoroughly goal orientated instruction and education. Classes given by BHMS will follow the framework of the offer published at the begin of the training.

2.2 Lessons last 40 to 50 minutes, according to course outline and course program.

2.3 BHMS reserves the right to change the program; however the training objective must not change fundamentally. Postponements of maximum 10 weeks are regarded as a change of organization and do not count as a termination of a course.

2.4 Courses are held only with a sufficient number of subscribers. BHMS reserves the right to cancel courses due to insufficient subscribers or due to circumstances beyond its control. Already paid school fees will be returned. Claims for damages or compensation in this case will not be entertained and the participant agrees that they are excluded.

2.5 Classes will be held in rooms determined by BHMS. A right of the participant to have classes or instruction in a specific classroom or a specific school building is excluded.

3. Cancellation, Contract Termination Course Changes
3.1 If a contract has been signed at least 37 days before course begin, participants have the right to withdraw without any expenses to them, by simply informing BHMS within seven days by registered letter of their intent. If the participant withdraws less than 37 days before course begin, or more than seven days after signing the contract, the following shall apply:

  • In case of a cancellation up to the 30th day before course begin, the registration fee is payable.
  • In case of a cancellation from the 29th and up to the 15th day before course begin, the agreed registration fee as well as three months course fees are due.
  • In case of a cancellation from the 14th day before course begin the agreed registration fee as well as six month course fees are due.
 

3.2 After course begin for full time courses lasting only one semester, it is not possible to terminate the course. In such cases the semester fees of the current semester as well as the registration fee are due and payable in full.

3.3 After course begin for part time courses lasting more than one semester, a contract termination is only possible to the end of a semester. This has to be indicated to the school management latest 60 days before the end of a semester by registered letter. Contract terminations which do not follow the above time frame are invalid. In such cases the semester fees of the current semester as well as the registration fee plus any installments for the following semester are due. With a timely notice, only the fees of the current semester plus registration fee is due.

3.4 Deductions or refunds of course fees for vacations, military duties, illness, accident and professional absences are not entertained or permitted.

3.5 In reasonable and justified cases, courses which have been started can be postponed or continued in another BHMS school (Zürich or Luzern, provided that the courses are courses offered and carried out.
In case of adverse circumstances, which have occurred to participants without their blame, class- or school changes are permissible, or the course can be continued (at reduced cost). In this case the school management will decide solely on the amount of fees due. Corresponding requests are to be presented to the management in writing.

4. Final Provisions
4.1 BHMS is not liable for any accidents, loss, or theft of private property, or for objects deposited, or any liability incurred by participants. It is the duty of the participant to take out insurance such occurrences.

4.2 School-, house-, and attendance-, as well the graduation and examination rules and the participants’ adherence to them, are an integrated part of this agreement.

4.3 Place of performance and place of jurisdiction is Zürich. However, BHMS reserves the right to prosecute customers at their domicile. Verbal agreements unless confirmed in writing are not valid.

4.4 If any provision or part thereof, contained or implied in this agreement, shall be found to be illegal, unenforceable, void or violable in law or in equity, or, in violation of public policy, every other provision of this Agreement or part thereof shall be and remain valid and enforceable to the fullest extent permitted by law.
